In order to guarantee the privacy and the right to informative self-determination of individuals, in accordance with the provisions of the Federal Law on the Protection of Personal Data in the Possession of Individuals (the “Law”), we inform you that WARRANTY SUPPORT LATAM S.A. DE C.V. (“THE COMPANY”), with the address at 412 Nubes Street, Colonia Jardines del Moral, postal code 37160, León, Guanajuato, is responsible for the legitimate, controlled and informed processing of your personal data.

In terms of the Law, by providing your personal information to THE COMPANY, unless you state the contrary, you tacitly agree to the processing of the information in accordance with what is established in this privacy notice.

Your personal data may be processed without your consent in the following cases: (i) where required by law; (ii) the information is from publicly available sources; (iii) the personal information is subject to a prior dissociation procedure; (iv) it is intended to fulfill obligations derived from a legal relationship between the holder and the responsible party; (v) there is an emergency situation which could potentially harm an individual or his property; (vi) indispensable activities in relation to the social object, as long as the holder is not in a position to give consent, under the terms of the applicable laws and legal dispositions, and that such processing is carried out by a person subject to professional confidentiality or an equivalent obligation; or (vii) a decision is taken by a competent authority.

Personal Information

THE COMPANY collects personal information from its clients, including but not limited to the following: full name, sex, nationality, contact telephone numbers, address, marital status, occupation, e-mail address, age, place and date of birth, Federal Taxpayers Registry, Unique Population Registry Code, Advanced Electronic Signature, bank accounts and other necessary information for the proper performance of its activities and provision of its services.

Such personal information may be obtained directly from you, either personally or through any electronic, optical, audio, visual or any other technological way, as well as through third parties and other sources allowed by applicable legal regulations, or created as a result of the services requested or purchased by you with THE COMPANY.

THE COMPANY has the security, administrative, technical and physical necessary means to safeguard the privacy and confidentiality of your personal information, as well as to comply with the principles of personal information protection established by the Law.

Purpose of Personal Information Processing

The processing of personal information collected by THE COMPANY will be the one that is necessary, adequate and relevant for the fulfilment of the following purposes: (i) the performance of each and every one of the activities and the provision of the services that, in accordance with the applicable legal provisions, THE COMPANY and its subsidiaries or affiliates may carry out, as they are purchased and requested by our clients; (ii) the fulfilment of the applicable legal dispositions and of the obligations agreed with our clients; (iii) to inform about new products or services or changes in them; (iv) the promotion of our products and services; (v) the evaluation of the quality of our services, including the carrying-out of surveys, as well as the creation and implementation of necessary or convenient analytical and statistical processes for such effects; (vi) the fulfilment of the requirements of any competent authority; (vii) the carrying out of consultations, investigations and reviews in relation to any complaint or claim; and (viii) the carrying out of any complementary, auxiliary, compatible or analogous activity to the above purposes, without having to obtain their consent again.

Personal Information Transfer

In order to be able to comply with the purposes foreseen in this privacy statement, when in the opinion of THE COMPANY it may be necessary, certain personal information of our clients may be transferred to third parties, THE COMPANY being obliged in any case to ensure compliance with the principles of personal information protection established in the Law and to take the necessary and sufficient measures to ensure that both the Law and this privacy statement are respected at all times by him or the third parties to whom THE COMPANY transfers personal information.

In this regard, THE COMPANY may transfer your personal information, among others, to its subsidiaries and affiliates, authorities and self-regulatory entities and to third party providers of the necessary services for its proper operation and for compliance with the purposes set forth in this privacy statement.

Unless you express your disagreement, it will be understood that you give your consent to THE COMPANY to transfer your personal information to third parties, whenever this is necessary for the fulfilment of the purposes established in this privacy statement. According to the above, it is understood that the third party receptor will assume the same responsibilities and/or obligations of THE COMPANY derived from the present privacy statement, and must respect it at all times.

Notwithstanding the foregoing, THE COMPANY may carry out the transfer of your personal information without your consent in the following cases: (i) when the transfer is required by a law or agreement in which Mexico is part of; (ii) when the transfer is necessary for the fulfilment of its social object, which is, among others, to buy, sell, import, alienate, acquire, distribute, commercialize, import and export all kinds of merchandise, products and articles of commerce, as well as components, elements, spare parts and accessories for all types of electronic devices and domestic appliances, as well as to carry out any act of any nature that is permitted by law; (iii) when the transfer is made to controlling companies, subsidiaries or affiliates under the common control of the person in charge, or to a parent company or any company in the same group of the person in charge operating under the same internal processes and policies; (iv) when the transfer is necessary by virtue of a contract made or to be made in the interest of the holder, by the person in charge and a third party; (v) when the transfer is necessary or legally required for the safeguarding of a public interest, or for the procurement or administration of justice; (vi) when the transfer is necessary for the recognition, exercise or protection of a right in a judicial proceeding; and (vii) when the transfer is necessary for the maintenance or enforcement of a legal relationship between the information holder and the person in charge.

Means for Exercising Rights of Access, Rectification, Cancellation and Opposition

In accordance with the stipulations of the Law, beginning on January 6, 2012, you will have the right, at all times, to access your personal information held by THE COMPANY; to rectify it if it is inaccurate or incomplete; to instruct us to cancel it when you consider it to be excessive or unnecessary for the purposes for which it was obtained or the contractual relationship with THE COMPANY has ended; as well as to oppose the processing of your personal information for legitimate reasons.

The application shall contain and be accompanied by the following: (i) your name and address or any other means of communicating our response to you; (ii) documents proving your identity and/or that of your legal representative; (iii) a clear and precise description of the personal information in respect of which any of the above rights are sought to be exercised; (iv) any other document or element that makes it easier to locate your personal information; and (v) in the case of requests for rectification, you must also indicate the modifications to be made and provide the documentation supporting your request, if this is applicable.

Limitation on Use and Disclosure of Personal Information

In addition to the above rights, you have, at all times, the right to limit the use or disclosure of your personal information, as well as the right to stop receiving promotional messages or advertising.

In order to exercise this right, the respective request must be sent to our Specialized Customer Service Department to the e-mail address and with the requirements indicated for the practice of the ARCO Rights, when applicable.

Revocation of Consent to the Processing of Personal Information

In addition, you will have, at all times, the right to revoke the consent granted to THE COMPANY for the processing of your personal information in terms of what is established in this privacy statement, without retroactive effects being attributed to the revocation.

Modifications to the Privacy Statement

THE COMPANY has the right to make, at any time, modifications or updates to this privacy statement as a result of legislative reforms, internal policies, and new requirements for the rendering or offering of our services and/or products, market practices or others. These modifications will be considered accepted if you do not express your disagreement with them within a period of 3 (three) days from the date they were made.

Modifications or updates will be incorporated into this privacy statement and will be available on our website, or will be sent to the last email you have provided to us.

Claims and Complaints

In the event that you consider that the right to the protection of your personal data has been violated by the conduct of our employees or by the actions of THE COMPANY and, therefore, presume that there is some violation of the stipulations of the Law, you may submit the corresponding complaint to the National Institute of Transparency, Access to Information and Protection of Personal Information (Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales).
